These Terms and Conditions (T&C) apply to all business relationships between Printerthur 3D (hereinafter “Service Provider”) and its customers (hereinafter “Client”).

Deviating conditions of the Client are not recognized unless the Service Provider expressly agrees to their validity in writing.
These T&C also apply to all future transactions with the Client, provided they are transactions of a related nature.
All offers from the Service Provider are subject to change and non-binding unless expressly marked as binding.
The Client submits a binding offer to conclude a contract by submitting an order (via email, contact form, or verbally).
The contract is concluded by:
Change requests after order confirmation may result in additional costs and delays and require written agreement.
The Service Provider provides the following services:
The Client provides printable CAD files (preferably STL, STEP, IGES) or commissions CAD design.
The Client is responsible for the correctness and completeness of their specifications.
The Service Provider advises on material selection. The final decision and responsibility for material suitability lies with the Client, unless they expressly commission consultation on suitability.
All prices are in Swiss Francs (CHF) plus statutory value-added tax (VAT) of currently 8.1%.
Prices are calculated individually according to effort and stated in the offer.
For New Customers:
For Existing Customers:
The delivered components remain the property of the Service Provider until full payment.
The stated delivery times are non-binding estimates unless expressly agreed as binding.
Delivery times begin with order confirmation and receipt of all required documents and, if applicable, the advance payment.
In case of delivery delay by the Service Provider, the Client is entitled to set a reasonable grace period. After the grace period expires without result, the Client may withdraw from the contract.
In case of force majeure (e.g., natural disasters, operational disruptions, strikes), the delivery period is extended appropriately.
Shipping is at the Client’s cost and risk unless otherwise agreed.
Shipping Costs:
Components can be collected in Winterthur by arrangement (free of charge).
The Client must inspect the goods for defects immediately upon receipt.
Obvious defects must be reported in writing within 7 days of receipt.
Hidden defects must be reported immediately upon discovery, but no later than 12 months after delivery.
In case of justified defect notification, the Service Provider has the right to rectification or replacement delivery.
If rectification or replacement delivery fails twice, the Client may demand reduction or reversal of the contract.

Manufacturing-related tolerances are common in 3D printing:
The Service Provider is only liable for intent and gross negligence.
Liability for indirect damages, consequential damages, and lost profits is excluded to the extent legally permissible.
Liability is limited to the value of the order.
The Service Provider is not liable for damages resulting from incorrect or incomplete specifications by the Client.
The Client indemnifies the Service Provider against all third-party claims arising from defective specifications or faulty specifications by the Client.
All CAD data, drawings, and documents provided by the Client remain the Client’s property.
The Service Provider undertakes to treat this data confidentially and not to disclose it to third parties.
If the Service Provider creates CAD designs on behalf of the Client, usage rights transfer to the Client after full payment.
Copyrights remain with the Service Provider.
With full payment, all usage rights for printed components transfer to the Client.
The Service Provider reserves the right to use manufactured components (without naming the customer) for portfolio and marketing purposes, unless the Client expressly objects.
The Service Provider undertakes to treat all Client information and data strictly confidentially.
At the Client’s request, a separate non-disclosure agreement (NDA) can be concluded.
All customer data is stored on encrypted servers and deleted after project completion unless otherwise agreed.
The Client can cancel the order free of charge until the start of production.
After production has started, the following costs will be charged:
The Service Provider may withdraw from the contract in case of:
Exclusively Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction for all disputes is Winterthur, Switzerland.
Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions remains unaffected.
The invalid provision will be replaced by a valid regulation that comes closest to the economic purpose of the invalid provision.
Changes and additions to these T&C require written form.
The Service Provider reserves the right to change these T&C for future transactions. Changes will be communicated to the Client in good time.
These T&C are available in German and English. In case of doubt, the German version is authoritative.
